TERMS OF USE OF DOMNEED.SI

Document version: 2026-08 · Date: August 2026

In brief

DomNeed.si is an online platform for publishing and searching real estate listings, primarily intended for real estate located in the Republic of Slovenia.

Users independently publish listings, browse offers, contact one another, and independently negotiate the sale, purchase, lease, rental, or other transaction relating to real estate.

Unless expressly stated otherwise, DomNeed is not the seller, buyer, landlord, tenant, or a contracting party to an agreement between users. The mere fact that a listing is published on DomNeed does not mean that DomNeed acts as a real estate agency or intermediary in a particular transaction.

The user is responsible for the legality, truthfulness, and accuracy of their listing, for keeping it up to date, and for having the right to offer the relevant property.

The DomNeed.si Listing Rules additionally apply to the publication of listings.

The DomNeed.si Payment Terms additionally apply to paid services.

The contract for the publication service relating to a specific listing is concluded at the moment of that listing’s first successful publication. The service begins immediately upon publication, including the initial free part of the calendar month where applicable.

A consumer to whom the statutory right of withdrawal from a distance contract applies retains all mandatory rights provided by applicable law, irrespective of DomNeed’s commercial rules.

This summary is provided solely for ease of understanding. In the event of any inconsistency, the full text of these Terms of Use shall prevail.

1. Operator of DomNeed.si

The operator of DomNeed.si is:

  • Nicole Daniel Svetovanje s.p.
  • short company name: Nicole Daniel s.p.
  • Registered office: Rakuševa ulica 8, 1000 Ljubljana, Slovenia
  • Registration number: 7381867000
  • Tax number: 74738518
  • Email: support@domneed.si

In these Terms, the expressions DomNeed, DomNeed.si, Operator, we, us, and our are used.

Current information about the Operator must be available on DomNeed.si in an easy, direct, and permanent manner, including through the relevant Legal Notice / Impressum section.

2. Subject matter of these Terms

These Terms govern:

  • access to DomNeed.si;
  • registration and use of a user account;
  • use of platform features;
  • publication and management of listings;
  • general rights and obligations of users;
  • general contractual relations between the user and DomNeed;
  • rules concerning user content;
  • moderation;
  • restrictions on use of the platform;
  • general provisions concerning paid services;
  • restriction or termination of access;
  • liability;
  • applicable law and the procedure for submitting complaints or claims.

Certain matters are additionally governed by specific DomNeed documents.

3. Related legal documents

The following may apply together with these Terms:

  • the DomNeed.si Listing Rules;
  • the DomNeed.si Payment Terms;
  • the DomNeed.si Privacy Policy;
  • the DomNeed.si Cookie Policy;
  • other specific terms applicable to an individual feature, if introduced.

Where a specific document regulates a particular matter in greater detail, its provisions shall prevail in relation to that matter.

In particular:

  • the content and admissibility of listings are primarily governed by the Listing Rules;
  • prices, free periods, promotional terms, billing periods, payment deadlines, non-payment, and refunds are primarily governed by the Payment Terms;
  • the processing of personal data is governed by the Privacy Policy.

4. Purpose of DomNeed.si

DomNeed is an online real estate platform.

Depending on the functionality available at any given time, DomNeed may enable users to:

  • publish listings for the sale of real estate;
  • publish listings for the rental or lease of real estate;
  • search for real estate to purchase;
  • search for real estate to rent;
  • search for short-term accommodation where such a category is available;
  • browse listings;
  • use filters;
  • view properties on a map;
  • save listings;
  • manage their own listings;
  • contact advertisers;
  • use a professional or business profile;
  • use paid features;
  • use other features related to real estate.

DomNeed may develop, modify, add, or discontinue individual features, subject to compliance with mandatory contractual and statutory requirements.

5. DomNeed as a platform and not as a party to a real estate transaction

Unless expressly provided otherwise as part of a specific service, DomNeed:

  • is not the owner of the advertised property;
  • is not the seller;
  • is not the buyer;
  • is not the landlord;
  • is not the tenant;
  • is not a party to a sale and purchase agreement;
  • is not a party to a lease or rental agreement;
  • does not determine the price of the property;
  • does not determine the amount of rent;
  • does not determine the security deposit or earnest money;
  • does not receive the purchase price of the property;
  • does not receive rent between the parties to the transaction;
  • does not receive earnest money on behalf of the seller or landlord;
  • does not enter into a property agreement on behalf of the user;
  • does not receive a commission calculated as a percentage of the value of the real estate transaction merely because the parties found each other through DomNeed.

Payments made by a user to DomNeed are payments for platform services and do not constitute payments under the underlying real estate transaction.

6. DomNeed is not automatically a real estate agency

Providing a technical platform for the publication of listings does not, in itself, mean that DomNeed acts as a real estate agency or licensed real estate intermediary in a particular transaction.

The user independently decides whether they require:

  • a licensed real estate agent;
  • a notary;
  • a lawyer;
  • a tax adviser;
  • a valuer;
  • an architect;
  • an engineer;
  • another professional.

If DomNeed introduces a separate service of a different legal nature in the future, that service shall be governed separately.

7. Visitors

Certain DomNeed features may be available without registration.

Where the relevant feature is available, a visitor may:

  • browse public listings;
  • use the search function;
  • use public filters;
  • view publicly available information about properties and advertisers.

A user account may be required to publish a listing, manage listings, and use other personalised features.

8. Age and legal capacity

By creating an account or entering into a contract with DomNeed, a natural person confirms that they:

  • have reached the age required to enter into the relevant contract independently; and
  • have the necessary legal capacity.

Unless mandatory law provides otherwise, a user entering into a contract with DomNeed independently must be at least 18 years old.

A person acting on behalf of a company, real estate agency, entrepreneur, investor, or other entity confirms that they have the necessary authority to do so.

9. Private and professional users

DomNeed distinguishes between private and professional use of the platform.

Professional users may include, in particular:

  • real estate agencies;
  • licensed real estate agents;
  • sole traders;
  • companies;
  • investors;
  • developers or operators of real estate development projects;
  • other persons using DomNeed in the course of their professional or commercial activity.

The mere fact that a user is a sole trader or operates a company does not, by itself, mean that the user is a real estate agency.

10. Advertiser role for an individual publication

DomNeed may require the user to indicate the capacity in which they publish a particular listing.

Supported roles may include:

  • private_owner – a private owner or an authorised private individual;
  • real_estate_agency – a real estate agency or professional real estate intermediary;
  • business_owner – a company or entrepreneur offering the property directly and not acting, in the particular listing, as a real estate agency for a third party;
  • investor_developer – an investor or real estate developer.

The selected role must reflect the user’s actual status.

It is prohibited to deliberately select an incorrect role in order to conceal professional status or avoid mandatory requirements.

11. Registration

To publish a listing, the user must create a user account unless DomNeed provides another permissible method.

During registration, the user must provide truthful and current information.

The user may not create an account in the name of another person or organisation without appropriate authorisation.

12. Acceptance of legal documents upon registration

Upon registration, the user must expressly confirm the required legal package.

This may include:

  • acceptance of the Terms of Use;
  • acceptance of the Listing Rules;
  • confirmation that the user has reviewed the Privacy Policy.

The mandatory checkbox for accepting legal documents must not be pre-selected.

DomNeed may retain evidence of acceptance, including:

  • user_id;
  • date and time of acceptance;
  • version of the Terms of Use;
  • version of the Listing Rules;
  • version of the Privacy Policy;
  • version of the legal bundle;
  • language;
  • source of acceptance.

Versions and legally relevant timestamps are determined by a trusted server or database system and not by arbitrary values supplied by the browser.

13. Marketing consent is separate from legal acceptance

Consent to receive marketing communications:

  • is voluntary;
  • is separate from mandatory legal acceptance;
  • must not be pre-selected;
  • is not a condition for creating an account;
  • may be withdrawn.

Opting out of marketing communications does not prevent the sending of necessary:

  • security messages;
  • contract confirmations;
  • payment notifications;
  • legal notices;
  • moderation notices;
  • important account-related notices;
  • other non-marketing communications necessary for performance of a contract or compliance with law.

14. Account security

The user must take reasonable care to protect their access credentials.

The user must:

  • use the account lawfully;
  • not grant access to unauthorised persons;
  • keep material information up to date;
  • notify DomNeed without undue delay if unauthorised access is suspected.

Security-related questions may be sent to:

support@domneed.si

15. Right to advertise the property

By publishing a listing, the user confirms that they:

  • are the owner of the relevant property; or
  • are authorised to act on behalf of the owner; or
  • have another valid legal basis for offering or advertising the property.

DomNeed may request reasonable evidence of such right or authority.

16. Prohibition on advertising another person’s property without legal basis

Without a lawful basis, the user may not:

  • advertise another person’s property;
  • represent themselves as the owner;
  • represent themselves as a real estate agent;
  • represent themselves as an authorised representative;
  • use another person’s or entity’s company name;
  • use another person’s professional information;
  • publish another person’s contact details.

17. Professional profile

DomNeed may allow a professional user to store business information in a separate professional profile.

Such information may include:

  • publisher role;
  • full legal company name;
  • registered office;
  • registration number;
  • agent name;
  • licence number;
  • business email address;
  • business telephone number;
  • website;
  • verification status by DomNeed.

The professional user must keep this information up to date.

18. Professional advertisers

A professional user must comply with the legislation applicable to their activity.

DomNeed may require additional information and evidence necessary for lawful publication.

For a real estate agency, this may include:

  • company name;
  • registered office;
  • confirmation of authority to advertise the property;
  • professional details of the real estate agent;
  • other mandatory information.

The professional user remains responsible for compliance with the legislation governing their professional activity.

19. Real estate agency advertising its own property

Where a real estate agency advertises property owned by the agency itself, the user must correctly disclose this circumstance where required by law or by the DomNeed form.

DomNeed may publicly display a specific notice stating that the advertising real estate agency is also the owner of the property.

20. Real estate agent licence and verification status

DomNeed may allow the user to enter a real estate agent’s licence number.

The mere entry of a licence number by the user:

  • does not mean that DomNeed has verified it;
  • does not create “Verified” status;
  • does not constitute a guarantee that the licence is valid.

Verification status may be displayed only after DomNeed has actually carried out the relevant verification.

21. Advertiser information and historical evidence

The current public listing page may display the advertiser’s currently applicable information.

At the same time, DomNeed may retain immutable historical information showing which professional identity was associated with the listing at the time of a particular publication.

Such information may include:

  • the advertiser’s role;
  • company name;
  • registered office;
  • agent name;
  • licence number;
  • website;
  • whether the advertising company owned the property;
  • date on which the information was captured.

A later change to the professional profile does not necessarily alter historical evidence relating to an earlier publication.

22. Listing requirements

A listing must be:

  • truthful;
  • current;
  • understandable;
  • related to the relevant property;
  • sufficiently accurate;
  • not misleading.

The user must comply with the Listing Rules.

23. Price and property characteristics

The user must provide, in good faith, the material characteristics required for the relevant type of listing.

For professional listings, DomNeed may technically require mandatory information prescribed by applicable law.

Depending on the type of property, this may include:

  • price;
  • location;
  • area;
  • year of construction;
  • year of renovation or reconstruction where relevant;
  • other mandatory information.

24. Contact information and public availability

DomNeed may require valid user contact information for:

  • registration;
  • security;
  • legal communications;
  • operation of listings;
  • payments.

Not all contact information associated with a user account becomes public automatically.

Publicly displayed information depends on:

  • the user’s role;
  • user settings;
  • type of listing;
  • legal requirements;
  • the platform interface in effect at the relevant time.

DomNeed is not required to publicly disclose the private home address of a private user.

25. User content

The user may provide:

  • a description;
  • photographs;
  • plans;
  • sketches;
  • documents, where supported by the system;
  • professional information;
  • other information relating to the property.

The user is responsible for the legality of such content.

26. Rights to uploaded content

The user confirms that they have the necessary rights and permissions to use:

  • photographs;
  • plans;
  • text;
  • images;
  • documents;
  • other materials.

Use of content that infringes copyright, personality rights, or other rights of third parties is prohibited.

27. Licence granted to DomNeed for user content

The user retains their rights in content they have created.

At the same time, the user grants DomNeed a non-exclusive right to use the content to the extent necessary for:

  • storage;
  • technical processing;
  • resizing;
  • compression;
  • creation of previews;
  • conversion of technical format;
  • display;
  • distribution of the listing through DomNeed;
  • automatic translation;
  • creation of localised versions of the listing;
  • promotion of the listing;
  • promotion of DomNeed, including displaying the listing through DomNeed marketing channels.

The licence is limited to the purposes of operating and promoting the platform and the listing.

28. Termination of the licence after deletion

Following final deletion of the content, its ordinary public use by DomNeed shall cease within a reasonable technical period.

Exceptions may include:

  • backups;
  • legal evidence;
  • accounting or audit records;
  • fraud prevention;
  • dispute resolution;
  • lawful requests from competent authorities;
  • independent caching or indexing by third parties outside DomNeed’s control.

29. Platform languages

DomNeed supports:

  • Slovenian;
  • English;
  • German;
  • Russian.

Legal documents may be separately approved in each language version.

30. Automatic translation of listings

DomNeed may automatically translate user content between supported languages.

Automatic translation is provided for convenience.

DomNeed does not guarantee complete accuracy of machine translation.

The original user-provided text remains the source content unless the system expressly provides otherwise.

31. Address, location, and map

DomNeed may use:

  • address information;
  • coordinates;
  • geocoding;
  • reverse geocoding;
  • mapping services.

The user must verify the accuracy of the location.

Deliberately providing a false location is prohibited.

32. Hiding the exact address

Where the feature is available, the exact public address may be hidden.

In such a case, the public listing may display:

  • an approximate location;
  • district or neighbourhood;
  • settlement;
  • municipality;
  • other less precise geographical information.

DomNeed may continue to store precise data internally in accordance with the Privacy Policy.

33. Prohibited content

It is prohibited to publish:

  • fraudulent listings;
  • non-existent property represented as genuinely available;
  • knowingly false information;
  • unlawful content;
  • content that infringes third-party rights;
  • personal data disclosed without proper justification;
  • discriminatory content prohibited by law;
  • malicious code;
  • spam;
  • unrelated advertising;
  • other content prohibited by the Listing Rules.

34. Prohibited use of the platform

It is prohibited to:

  • commit fraud;
  • obtain unauthorised access;
  • attempt to circumvent security mechanisms;
  • interfere with operation of the platform;
  • manipulate payment or promotional mechanisms;
  • attempt to falsify legal acceptance;
  • attempt to alter historical evidence;
  • access another user’s data without legal basis;
  • send mass unsolicited communications;
  • carry out excessive automated scraping;
  • copy a substantial part of the listings database in order to create a competing database or service;
  • distribute malicious software.

Ordinary indexing of publicly accessible pages by legitimate search engines may be permitted in accordance with the technical settings of the website.

MODERATION AND SAFETY

35. Moderation

DomNeed may moderate user content before or after publication.

Moderation may be carried out:

  • on the basis of a report;
  • on DomNeed’s own initiative;
  • through administrative review;
  • through automated technical checks;
  • through a combination of automated checks and human review.

DomNeed describes in these Terms, in a transparent manner and to the extent applicable, the restrictions imposed on user content and the policies, procedures, measures, and tools used for moderation.

36. Automated checks

DomNeed may automatically check, in particular:

  • mandatory fields;
  • permitted statuses;
  • access rights;
  • existence of required legal acceptance;
  • requirements applicable to professional advertisers;
  • publication rules;
  • entitlement to a particular DomNeed service price;
  • technical correctness of data.

Automated technical validation does not mean that DomNeed has fully verified the legal or factual accuracy of the property.

37. Possible moderation measures

Where justified grounds exist, DomNeed may:

  • request additional information;
  • require correction of a listing;
  • correct technical formatting;
  • change a category;
  • restrict visibility;
  • hide a listing;
  • reject publication;
  • unpublish a listing;
  • remove content;
  • restrict a particular feature;
  • temporarily restrict a user account;
  • terminate access in cases permitted by law.

The measure must take into account the nature and seriousness of the violation and applicable mandatory legal requirements.

38. Reporting problematic or illegal content

DomNeed may provide a Report listing function or another accessible reporting channel.

A user may report, in particular:

  • fraud;
  • illegal content;
  • copyright infringement;
  • inaccurate information;
  • false advertiser identity;
  • non-existent property;
  • duplicate listing;
  • property that is no longer available;
  • unauthorised use of data;
  • another problem.

To process a report, DomNeed may require sufficient information to identify the content and the alleged infringement.

39. Reasons for restrictions

Where applicable law requires reasons to be provided for a decision, DomNeed shall provide the user with a sufficiently specific reason for the relevant measure.

Such information may include:

  • the factual basis;
  • the rule applied;
  • the nature of the restriction;
  • information about automated or human review, where required;
  • available options for redress or appeal.

40. Appeal against a DomNeed decision

If the user believes that a moderation measure was incorrect, they may contact:

support@domneed.si

DomNeed shall consider such a request in accordance with applicable obligations and internal procedures.

This provision does not limit any other remedies provided by law.

41. Repeated or serious infringements

Serious or repeated infringements may result in stricter measures.

DomNeed may take into account:

  • frequency of infringements;
  • seriousness of the infringements;
  • consequences;
  • existence of intent;
  • previous warnings;
  • likelihood of recurrence;
  • risk to other users and to the platform.

REAL ESTATE TRANSACTIONS

42. Users independently agree the terms of the transaction

Users independently agree on:

  • the property price;
  • rent;
  • security deposit;
  • earnest money;
  • handover date;
  • condition of the property;
  • method of payment;
  • contractual terms;
  • other terms of the transaction.

43. Property verification by the user

Before entering into a transaction, the user must independently verify material circumstances.

This may include:

  • identity of the other party;
  • authority of a representative;
  • ownership;
  • land register records;
  • encumbrances;
  • third-party rights;
  • permits;
  • actual floor area;
  • technical condition;
  • energy performance certificate;
  • costs;
  • tax consequences;
  • legal status;
  • permitted use.

44. DomNeed does not replace professional verification

DomNeed does not replace:

  • a notary;
  • a lawyer;
  • a real estate agent;
  • a tax adviser;
  • a valuer;
  • an architect;
  • an engineer;
  • a construction expert;
  • another professional.

45. No guarantee regarding listing content

DomNeed may carry out moderation and technical checks, but unless expressly stated otherwise, DomNeed does not guarantee:

  • the existence of every property;
  • every user’s right to dispose of or offer the property;
  • the validity of every licence;
  • that the price corresponds to market value;
  • the absence of encumbrances;
  • that every photograph is current;
  • complete legal compliance of the property;
  • availability of the property at the time of enquiry.

Publication on DomNeed does not constitute a legal opinion or legal guarantee by DomNeed.

46. Safety in real estate transactions

The user should exercise caution, particularly if another person asks them:

  • to pay a substantial deposit before verifying the property;
  • to transfer money to an unknown person;
  • to use an unusual payment method;
  • to visit a suspicious website;
  • to provide a banking password;
  • to provide a PIN;
  • to provide a CVV;
  • to provide a one-time banking code.

DomNeed does not require the password to a bank account or a one-time code for access to a banking application for ordinary use of the platform.

CONTRACT FOR THE LISTING PUBLICATION SERVICE

47. Difference between registration and the contract for an individual listing

Registration establishes a general contractual relationship concerning use of the account and platform.

A separate contract for the publication service relating to a specific listing arises upon the first successful publication of that listing in accordance with these Terms and the applicable specific terms.

48. Time of conclusion of the contract for a listing

The contract between the user and DomNeed for the publication service relating to a specific listing is concluded at the moment of the first successful publication of that listing.

Before publication, the user is shown the information required by the system, including the applicable pricing model.

Where required, the user also expressly accepts the currently applicable version of the Payment Terms.

49. Commencement of the service

The publication service begins immediately upon the first successful publication.

If, under the applicable Payment Terms, the remainder of the first calendar month is free of charge, that free period is already part of the service that has commenced.

The fact that the initial period is free of charge does not postpone the time of conclusion of the contract.

50. Consumer

For the purposes of specific consumer-protection provisions, a consumer is a natural person who enters into the contract for purposes outside their trade, business, craft, or professional activity.

DomNeed may determine whether the consumer flow applies on the basis of the user’s actual role and account information.

Under the current model, a user publishing as a private user through a private account may be treated as a consumer, whereas professional roles and business or agency accounts are treated as acting in the course of a professional or commercial activity, unless the circumstances require a different assessment.

The legal classification in an individual case is determined by applicable law and not solely by a technical label used by the platform.

51. Consumer right of withdrawal from a distance contract

Where consumer distance-contract legislation applies, the consumer generally has the right to notify DomNeed within 14 days that they withdraw from the contract without having to provide a reason.

For a service contract, commencement of the withdrawal period is generally linked to conclusion of the contract.

Under the DomNeed model, the contract for the service relating to an individual listing is concluded upon first publication, and the applicable withdrawal period therefore begins at that time unless mandatory law provides otherwise.

52. Express request for immediate commencement of the service

Because the listing is published immediately, the service begins before expiry of the 14-day withdrawal period.

Where required for a consumer, before the first publication DomNeed obtains a separate and express request from the user for the service to begin before expiry of the withdrawal period.

Such confirmation:

  • must not be pre-selected;
  • relates to the specific listing;
  • is retained as legal evidence;
  • is recorded using a trusted timestamp.

53. Consequences of full performance of the service

A consumer does not lose the right of withdrawal merely because performance of the service has begun.

Where applicable law provides that the right of withdrawal ceases following full performance of the service, such cessation occurs only where all statutory conditions have been met, including any required prior express consent and appropriate information provided to the consumer.

54. Withdrawal after performance has begun

If the consumer lawfully withdraws from the contract after performance has already begun at the consumer’s express request, mandatory legal rules concerning the consequences of such withdrawal apply.

Where the law requires a proportionate payment for the part of the service already provided, that mandatory calculation takes precedence over DomNeed’s ordinary commercial rule that no daily pro rata calculation applies.

In particular, the rule requiring payment of the full monthly price cannot exclude a mandatory consumer right.

55. Free period and withdrawal

If, by the time of a lawful withdrawal, the consumer has used only the free part of the initial calendar month and the Payment Terms do not provide for any charge for that period, DomNeed does not convert that free period into a paid period solely because the consumer exercised the right of withdrawal.

This does not exclude other consequences required by mandatory law.

56. How to exercise the right of withdrawal

If the consumer wishes to exercise the statutory right of withdrawal from a distance contract, they must notify DomNeed of that decision by an unequivocal statement before expiry of the applicable period.

The statement may be sent by:

Email: support@domneed.si

or in writing to:

Nicole Daniel Svetovanje s.p.

Rakuševa ulica 8

1000 Ljubljana

Slovenia

Use of the model withdrawal form in the Appendix is permitted but is not mandatory where the statement clearly expresses the consumer’s decision to withdraw.

57. Hiding a listing is not the same as statutory withdrawal

Ordinary:

  • hiding of a listing;
  • unpublishing;
  • moving the listing to draft status;
  • marking it as “sold”;
  • marking it as “rented”;
  • discontinuing future publication;

does not, in itself, necessarily constitute exercise of the statutory right of withdrawal.

To exercise the statutory right of withdrawal, the user must clearly inform DomNeed of their decision.

58. Contract confirmation on a durable medium

Upon the first publication, the consumer receives confirmation of the concluded contract in a form intended for storage and unchanged reproduction.

DomNeed stores an immutable confirmation linked to the specific user and listing.

It may include:

  • Operator information;
  • information relating to the specific listing;
  • time of conclusion of the contract;
  • version of these Terms;
  • version of the Payment Terms;
  • version of the withdrawal information;
  • confirmation of the request for immediate commencement of the service;
  • applicable pricing information;
  • information about the right of withdrawal;
  • contact details for exercising the right.

The confirmation is provided to the user through their personal area and is available for saving or downloading. If DomNeed introduces suitable email infrastructure, it may also be delivered as a transactional email.

59. Immutability of the confirmation

The historical contract confirmation must not be altered as a result of:

  • changes to the current listing;
  • changes to the profile;
  • changes to the company name;
  • changes in price;
  • subsequent amendments to these Terms;
  • subsequent amendments to the Payment Terms.

DomNeed may retain such confirmation as append-only legal evidence.

PRICES AND PAYMENTS

60. Paid services

Certain DomNeed services may be paid services.

Before the relevant obligation arises, the user is given access to the applicable pricing information.

61. Payment Terms prevail for billing

Detailed rules are governed by the DomNeed.si Payment Terms.

These include, among other things:

  • the initial free period;
  • the applicable price;
  • promotional conditions;
  • the first 100 qualifying listings;
  • the standard price;
  • the billing period;
  • the ordinary absence of daily pro rata billing;
  • the payment deadline;
  • non-payment;
  • refunds;
  • SumUp.

To avoid inconsistencies, these Terms do not duplicate specific prices as permanent contractual provisions.

62. Pricing information before publication

Before publication, DomNeed displays authoritative pricing information applicable to the specific listing.

This may include:

  • the initial free period;
  • the date of the first paid period;
  • promotional status;
  • the applicable monthly price;
  • the billing method.

The client application is not the authoritative source of price information.

63. Acceptance of Payment Terms for publication

Where the applicable process requires acceptance of the Payment Terms, the user must expressly accept them before publication.

The checkbox must not be pre-selected.

The acceptance:

  • relates to the specific listing;
  • records the applicable version;
  • may include a pricing snapshot;
  • may not be arbitrarily reused for another listing.

64. Historical price

The price of a particular billing period that has already arisen may be retained as an immutable snapshot.

A later change to the standard price does not retroactively alter the properly recorded historical price of a billing period that has already arisen.

65. Payment provider SumUp

DomNeed uses the independent third-party payment service provider SumUp to process payments for platform services.

The user initiates each payment themselves.

Under the current model, automatic recurring card charges are not used.

66. Payment card data

DomNeed does not store:

  • the full payment card number;
  • CVV/CVC;
  • data that would, by itself, enable a card transaction to be carried out.

Payment card data is entered and processed in the SumUp payment environment.

DomNeed may store limited information required for payment reconciliation, such as:

  • checkout id;
  • reference;
  • amount;
  • currency;
  • status;
  • transaction id;
  • provider timestamps.

67. Payment confirmation

DomNeed does not treat a payment as successful solely on the basis of a return-page parameter or an unverified browser message.

Payment status may be confirmed by server-side verification with the payment provider.

68. Non-payment

If payment is not made within the prescribed period, DomNeed may apply the measures set out in the Payment Terms.

These may include restricting the public display of the listing.

Subsequent payment may remove only the restriction related to billing where no other independent ground for restriction exists.

69. Moderation and payments

Hiding or removing a listing due to a violation of the rules does not, by itself, create an automatic right to a refund of a charge that has already arisen.

Mandatory consumer rights and other mandatory legal provisions remain unaffected.

70. Changes to prices

DomNeed may change prices for future periods.

The new price must be presented to the user in accordance with applicable contractual and legal requirements before a new obligation arises, where such notice is required.

OPERATION AND LIABILITY OF THE PLATFORM

71. Availability of the platform

DomNeed aims to provide normal and secure operation of the website but does not guarantee absolutely uninterrupted operation.

Interruptions may occur due to:

  • maintenance;
  • updates;
  • bug fixes;
  • hosting;
  • network issues;
  • attacks;
  • software errors;
  • third-party APIs;
  • mapping services;
  • SumUp;
  • email infrastructure;
  • other circumstances.

72. External services

DomNeed may use third-party services for:

  • payments;
  • maps;
  • geocoding;
  • hosting;
  • databases;
  • file storage;
  • email;
  • analytics;
  • technical monitoring.

Their actual use and related processing of personal data are described in greater detail in the Privacy Policy.

73. External links

A listing or the user interface may contain a link to an external website.

DomNeed does not automatically control all content on an independent external website.

The user should exercise reasonable caution when visiting external resources.

74. DomNeed intellectual property

Unless otherwise stated, rights in DomNeed’s own elements belong to DomNeed or the relevant rights holders.

This may include:

  • software code;
  • design;
  • logo;
  • name;
  • original text;
  • user-interface structure;
  • legally protected databases, compilations, or selections of data.

75. Limitation of liability

To the extent permitted by law, DomNeed is not liable for:

  • performance of an agreement between users;
  • a decision to buy, sell, or rent a property;
  • conduct of the other party to the transaction;
  • market price;
  • hidden defects in a property that DomNeed did not inspect;
  • user error;
  • false information provided by a user;
  • acts or omissions of an independent third-party service where DomNeed is not liable under applicable law.

76. Liability that cannot be excluded

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Contractual limitations, in particular, do not affect mandatory consumer rights.

PERSONAL DATA AND COOKIES

77. Privacy Policy

The processing of personal data is governed by the separate DomNeed.si Privacy Policy.

It must describe the actual:

  • categories of data;
  • purposes of processing;
  • legal bases;
  • recipients;
  • processors;
  • retention periods or criteria;
  • rights of the data subject;
  • international transfers, where relevant.

78. Cookies

The use of cookies and similar technologies is governed by the Cookie Policy and the consent-management interface.

Non-essential cookies are used in accordance with applicable consent requirements.

DELETION AND TERMINATION

79. Account deletion

The user may request deletion of their user account through the available function or an appropriate request.

Deletion of the account may result in:

  • termination of access;
  • unpublishing of listings;
  • deletion or anonymisation of some data.

80. Data that may be retained after account deletion

Deletion of the account does not necessarily mean immediate deletion of all records.

Certain data may be retained where necessary for:

  • compliance with legal obligations;
  • accounting;
  • tax obligations;
  • proof of the contract;
  • proof of acceptance of the Terms;
  • records of acceptance of the Payment Terms;
  • consumer contract confirmation;
  • publication history;
  • professional identity at the time of advertising;
  • payment history;
  • fraud prevention;
  • security;
  • disputes;
  • establishment, exercise, or defence of legal claims.

Specific rules must comply with the Privacy Policy and applicable law.

81. Temporary restriction or termination of the account

DomNeed may restrict or terminate access in the event of serious or repeated infringements.

Grounds may include:

  • fraud;
  • illegal content;
  • violation of these Terms;
  • violation of the Listing Rules;
  • violation of the Payment Terms;
  • infringement of the rights of others;
  • attempts to circumvent security;
  • abuse of the system;
  • repeated violations.

82. Consequences of termination

Termination of access does not automatically extinguish:

  • payment obligations that have already arisen;
  • lawful rights of the user;
  • mandatory consumer rights;
  • DomNeed’s obligations to retain legal evidence;
  • rights of the parties in an existing dispute.

CHANGES TO LEGAL DOCUMENTS

83. Changes to these Terms

DomNeed may amend these Terms for objective reasons, including:

  • changes in law;
  • changes in functionality;
  • changes in technical architecture;
  • changes in the business model;
  • introduction of a new service;
  • security reasons;
  • correction of a legal error;
  • the need to align the document with the actual operation of the service.

84. Material changes

DomNeed shall inform registered users of a material change in accordance with applicable requirements.

Where a change requires new express acceptance, the system may require re-acceptance.

Previous acceptances are not overwritten and may be retained as historical evidence.

85. Non-material changes

Correction of:

  • typographical errors;
  • punctuation;
  • formatting;
  • a technical link;
  • a translation without any change to legal meaning;

does not necessarily require new acceptance where the substance of the parties’ rights and obligations has not materially changed.

LANGUAGE, LAW, AND DISPUTES

86. Language versions

DomNeed may publish these Terms in:

  • Slovenian;
  • English;
  • German;
  • Russian.

The system may record the language version presented to the user.

87. Slovenian version

Once approved, the Slovenian version is the principal legal version of DomNeed.si for relationships governed by Slovenian law.

This does not deprive the user of mandatory rights arising from the localised information actually presented to them and from applicable law.

88. Applicable law

Unless mandatory provisions require otherwise, these Terms and contractual relations with DomNeed are governed by the law of the Republic of Slovenia.

For consumers, the choice of Slovenian law does not result in the loss of protection afforded by mandatory provisions of law applicable to them under European Union law.

89. Direct contact with DomNeed

The user may contact DomNeed directly to resolve a question or complaint.

90. Alternative resolution of consumer disputes – ADR / IRPS

Nicole Daniel Svetovanje s.p. does not recognise any provider of alternative consumer dispute resolution (IRPS provider) as competent to resolve a consumer dispute that a consumer may initiate under ZIsRPS.

This information is provided in accordance with the Operator’s decision.

If a consumer submits a complaint to DomNeed and DomNeed does not uphold it, DomNeed shall provide the consumer with the information required by applicable law in such circumstances.

91. Former EU Online Dispute Resolution platform

DomNeed does not use the former EU Online Dispute Resolution platform (ODR) as a current method of dispute resolution.

A link to a discontinued or no longer applicable platform must not be presented to the user as a current dispute-resolution channel.

92. Judicial resolution of disputes

If a dispute cannot be resolved amicably, it shall be heard by the competent court in accordance with applicable rules on jurisdiction.

These Terms do not establish exclusive jurisdiction that would unlawfully deprive a consumer of a mandatory right to bring a claim before a competent court.

93. Invalidity of an individual provision

If an individual provision of these Terms is invalid or unenforceable, this does not, in itself, affect the validity of the remaining provisions.

Mandatory legal provisions and an interpretation permitted by law shall apply in place of the invalid provision.

94. Failure to exercise an individual right

If DomNeed does not require immediate enforcement of a particular provision in an individual case, this does not, in itself, constitute a waiver of that right in the future.

This provision does not apply where such an effect would be contrary to mandatory law.

95. Entire contractual documentation

For a particular feature, the contractual relationship may consist of:

  • these Terms;
  • the Listing Rules;
  • the Payment Terms;
  • specific pricing information;
  • the immutable contract confirmation;
  • other clearly applicable specific terms.

No internal technical DomNeed document, by itself, changes the user’s rights unless it has been properly incorporated into the contractual relationship or the law provides otherwise.
